A report from the Kino Border Initiative (KBI) and NETWORK described a Guatemalan asylum seeker’s experience with her children while in Border Patrol custody in Arizona.

A Guatemalan woman with her four children crossed into the United States with a big group and encountered a Border Patrol agent in a vehicle. That agent was very nice to them, gave them water and said they could have whatever they needed. He called for more vehicles to carry them all, and they were transferred to a Border Patrol facility that was very cold. Then they were put on buses to Tucson.

At the Tucson border facility, the woman approached an agent asking how they should apply for asylum and informing him that her son has a medical condition and needs medical care. She showed him the documents (a diagnosis, x-rays, etc.) to prove that her son was in need and that he needed surgery within the next two months. The agent took the documents and threw them in the trash. When she went to retrieve them from the trash, he took them again and told her “they belong in the trash.” When she protested, he became angry and told her to go away and gave her a sleeping mat. The mat was soaking wet so that she could not use it. She never got her documents back.

Hours later, she and the children were expelled to Nogales, Sonora.

A report from the Kino Border Initiative (KBI) and NETWORK discussed a Guatemalan family’s conditions in Border Patrol custody while seeking, without success, to seek asylum in Arizona.

A Guatemalan woman and her two young daughters entered the United States through the desert and encountered a Border Patrol agent. They were detained and moved to a facility with cold rooms. Then they were transferred to Tucson.

There, she told an agent that she had injured her foot while walking in the desert and needed medical attention. The agent agreed, but then she walked away and never came back. She was never given any medical attention.

They were made to sit in the chairs at the Tucson facility; the children could not sleep. At the facility, they were forced to take off any extra clothing and allowed to wear only a t-shirt and pants. Her daughter was shivering. They asked for blankets but were given only one small one many hours later. She tried to tell agents she wanted to seek asylum, but no one listened to her.

The next morning the family was expelled to Nogales, Sonora.

A report from the Kino Border Initiative (KBI) and NETWORK related the experience of a Guatemalan man, his wife, and son, who entered the United States in Arizona, with the intention of seeking asylum.

They crossed and encountered Border Patrol. The Border Patrol asked if their objective was to seek asylum, and the father said yes. The family was then transported to an outpost and processed. A CBP officer asked where they were from but did not ask any other questions.

They were transported to a facility in Tucson, where the man was separated from his wife and son. They were all moved between several different detention centers, and the only time the man was able to see his wife and son was during transport.

In one of the facilities, he told an agent he feared returning to Guatemala. The agent laughed in his face and said something to the other agents, who all laughed. He felt so humiliated and discouraged to ask for asylum again.

He was moved four times to different border facilities. Finally, he and his family were expelled in the very early morning hours without ever being given a fear assessment or referred to the USCIS.

A CBP release described a Border Patrol chase that ended with a fatal vehicle crash, after an agent deployed a vehicle immobilization device across an Arizona highway (original link).

On June 17, 2021, a Border Patrol Agent (BPA) observed two suspected undocumented migrants getting into a vehicle along Arizona State Route 85 (SR 85), approximately one and a half miles north of the Lukeville, AZ Port of Entry. Approximately 20 miles north of where the suspected undocumented migrants entered the vehicle, another BPA waiting on SR 85, activated his emergency lights and sirens and attempted to stop the vehicle. The vehicle did not stop and continued for approximately one mile, where another BPA deployed a vehicle immobilization device (VID) across the roadway. The driver of the suspected smuggling vehicle attempted to avoid running over the VID and subsequently lost control and crashed.

One of the two undocumented migrants in the vehicle, a male citizen of Mexico, was in critical condition and was transported to the Abrazo West Medical Center in Goodyear, AZ where he ultimately succumbed to his injuries on June 19, 2021.

This incident is being investigated by Homeland Security Investigations, the Arizona Department of Public Safety and reviewed by the U.S. Customs and Border Protection Office of Professional Responsibility. The Department of Homeland Security Office of Inspector General was also notified of the incident.

A report from the Kino Border Initiative (KBI) and NETWORK included a Jamaican migrant’s account of violent treatment by Border Patrol agents at Nogales, Arizona’s DeConcini port of entry.

A Jamaican man entered the United States at a port of entry to ask for asylum and was immediately confronted by two Border Patrol agents who physically attacked him. They knocked him to the ground with a plastic barrier and began beating and punching him. One agent put his foot on his neck as he lay on the ground. The agents dragged him across concrete into an office at the port of entry. A third agent told the two that what they were doing was wrong. The other agents dismissed her objection. The Jamaican man was then handcuffed to a bench. Later, he was taken to another room where he was photographed and fingerprinted. When the agents asked why he was there, the Jamaican man said he was seeking asylum. The agents asked where he was from and when he said Jamaica. The agents said, “this is what a bunch of you have been doing (running into the port of entry), you are getting out of here.” They took him to the Mexican immigration office. His friends were in Mexico waiting to see if he got across successfully. The Mexican immigration officers took photos of all their passports and asked them to go to Kino Border Initiative.

A report from the Kino Border Initiative (KBI) and NETWORK discussed rough treatment that a Guatemalan man said he received from Border Patrol agents who apprehended him in Arizona.

A Guatemalan man entered the United States through the desert with a group of several others. He encountered Border Patrol agents who tripped him, causing him to fall and injure his knee. His face was injured with thorns. He was in a lot of pain, and he asked for medical attention. The agents said they could not help him. They then forced him to walk for an hour in handcuffs. Then the agents drove him to the border station. He didn’t receive medical attention at the station. He was expelled from that station to Nogales, Sonora. Only after he arrived in Mexico did Kino facilitate medical attention.

Border Patrol agents pursued, for over 34 miles near Deming, New Mexico, two vehicles that failed to pull over. “At that point,” a CBP release reported (original link),

four undocumented migrants jumped from one of the moving vehicles on New Mexico State Road 146. While some BPAs [Border Patrol agents] stopped to render assistance, others continued to pursue the two vehicles which eventually stopped. Both drivers and their passengers were taken into custody by BPAs.

One of the four undocumented migrants who jumped from the moving vehicle, a female citizen of Ecuador, suffered head injuries and was eventually transferred to University Medical Center in El Paso, TX, where she was declared deceased by medical personnel on June 13, 2021.

A report from the Kino Border Initiative (KBI) and NETWORK reported a Mexican asylum seeker’s allegations that CBP used violence during one of his several unsuccessful attempts to ask for protection at a Nogales, Arizona port of entry.

A Mexican man presented himself at the DeConcini Port of Entry seeking asylum several times over a period of two days. He received threats that made him believe his life was in danger and even survived an attempted kidnapping in Nogales.

On May 16, he ran toward the port of entry, near where cars were crossing because he was afraid of his pursuers. CBP officers apprehended him there. He was punched, kicked, and beaten by about twelve officers. He told them that he wanted asylum because there were people in Mexico who were trying to kill him. CBP did not give him an opportunity to talk to anyone else and he was immediately expelled back to Mexico.

CBP called the Mexican police, who never came. They then called the Mexican Red Cross to take him to the General Hospital of Nogales in Sonora. The hospital did not take care of his wounds.

When released from the hospital, he tried again to enter the United States at the port of entry because people were following him. He tried asking for asylum to the 9 agents who detained him. However, the agents told him he had no right to be in the United States and asked him to be silent. The agents then took him to a room and questioned him but did not ask him about asylum. He was then expelled back to Mexico again.

Three Border Patrol agents shot 26-year-old San Diego resident Silvestre Vargas Estrada through the windshield of his car in Campo, California. Vargas Estrada was killed. Two passengers, believed to be Mexican men who had entered the country illegally, were not injured.

A release from the San Diego Sheriff’s Department reported:

Just before 10:30 p.m. on May 14, 2021, agents with the U.S. Border Patrol were involved in a pursuit with a vehicle containing three adult males. The pursuit ended in a gas station parking lot at the intersection of State Route 94 and Buckman Springs Road in Campo. A confrontation ensued, resulting in three agents discharging their firearms. The driver of the vehicle was struck by gunfire. The man was transported by ambulance to a local area hospital. Unfortunately, he was pronounced deceased shortly after arriving at the hospital (original link).

The Sheriff’s Department homicide unit was leading the investigation, the San Diego Union-Tribune reported on May 18, 2021. “The FBI, Department of Homeland Security Office of the Inspector General and U.S. Customs and Border Protection’s Office of Professional Responsibility also responded to the scene and will review the investigation.”

It was the second Border Patrol-involved fatal shooting in the agency’s San Diego sector in six months. An agent shot and killed David Angel Villalobos-Baldovinos following a reported altercation on October 23, 2020.

A report from the Kino Border Initiative (KBI) and NETWORK discussed a Guatemalan asylum seeker’s separation from her brother and inability to request asylum while in Border Patrol custody in Arizona.

A Guatemalan woman traveling with her son and brother were detained by Border Patrol once they entered the United States and processed at an open-air border facility. At the open-air facility, they did not ask them why they were in the US or give them a chance to claim asylum.

There, she was separated from her brother. She was told this was because he was a minor and not her son. She told the agent she had a power of attorney paper signed by her mother to care for her brother and presented the papers. They didn’t accept the papers.

They transferred them to Tucson. The three of them had fled Guatemala because of the murder of family members. In the Tucson facility, she could see her brother detained separately with the other minors. That was the last time she saw her brother as of the time this complaint was filed.

At the Tucson facility, she told an agent she was afraid to return to Guatemala and she tried to show documentation of violence, the death certificates of her family members killed by organized crime. The CBP agent told her that her documents were likely fake because she comes from a “corrupt” country. In addition, the CBP agents said that every day, immigrants come to the facility with this type of paperwork. She tried to persuade him to look up the names of the murders online so he could see she was telling him the truth and the documents were real. He did not. She and her son were expelled to Nogales, Sonora.

A Border Patrol vehicle participating in a pursuit of migrants on foot ran over two migrants near Kingsville, Texas. One, an adult male citizen of Honduras, died on the scene.

CBP reported that the two individuals were run over while they “were burrowed” in “extremely thick and tall grass,” attempting to conceal themselves from the pursuing agents. (Original link) “The initial investigation indicates BPAs [Border Patrol agents] were not aware anyone was burrowed in the grass nor were they aware anyone had been run over by a vehicle until informed by a migrant.”

The DHS Office of Inspector General was notified of the incident, which CBP reported was being “reviewed” by the Kenedy County, Texas Sheriff’s Office and CBP’s Office of Professional Responsibility, both of which “responded to the scene.”

A report from the Kino Border Initiative (KBI) and NETWORK described a Guatemalan woman’s account of being denied necessary surgery for a leg injury while in Border Patrol custody, then swiftly expelled to Mexico.

A Guatemalan woman entered the United States and was detained by Border Patrol and transferred to a border patrol facility. She had previously injured herself in the desert and could not walk well. When transported to the facility, a nurse told her she needed surgery to fix a broken bone and torn muscle. She was taken to a clinic where an X ray was taken and found that her tibia was shattered. The medical assistant then told the female border agent who was present that the woman needed an operation right away. The medical assistant told the woman that the surgery was absolutely necessary, and so she agreed to the operation. Then they transferred her to a hospital and changed the Border Patrol agent in of charge of her. It was now a male Border Patrol agent. He received all the paperwork. The woman did not receive any paperwork. The medical staff started prepping for the surgery, then all of a sudden they said they couldn’t do it. The medical staff then gave the woman a sedative and put a cast on. The nurse told her that wherever she goes next, that the women must have surgery. When she asked why they were not continuing with surgery, the medical staff apologized profusely and told her the agents were not going to allow the Guatemalan woman to stay in the U.S. long enough for an operation she desperately needed. Medical staff repeated that she must have surgery as soon as she can because her injuries were serious. The Border Patrol agent there then rushed the woman out of the hospital without allowing the woman to eat or change clothes or get any prescribed pain medication. Though she could barely walk, she was expelled to Nogales, Sonora without any crutches.

A report from the Kino Border Initiative (KBI) and NETWORK recounted Border Patrol agents’ refusal to allow a Mexican migrant in custody to report a drug-related crime.

A Mexican man entered the United States when individuals associated with organized crime demanded he carry a backpack full of drugs into the United States and threatened him with a razor. When he refused, they beat him.

Once the Mexican man regained consciousness, he turned himself in to Border Patrol. He told agents what happened to him, where Border Patrol could find the drugs and the men who assaulted him who belonged to a criminal gang. Still, the agents kept the man in the vehicle the whole day, picking up other immigrants and giving him only water to drink.

Once they came to the CBP facility and he was processed, he repeated what had happened to him. The CBP agent there laughed and asked if he wanted to file a police report. When he said yes, the agent said it would take too long.

He was never given an opportunity to express his fears about returning to Mexico or give information about the crime that had been committed against him. He was never given medical attention while in CBP custody and was left alone in a cell for long stretches of time despite his weakened state. He was soon expelled back to Mexico.

A report from the Kino Border Initiative (KBI) and NETWORK detailed the experience of a Cuban asylum seeker in Border Patrol custody in Yuma, Arizona and Campo (Pine Valley), California.

A Cuban man and his wife crossed into the United States and were detained. He was searched and their documents were confiscated. The man was separated from his wife, even though his wife told the agents they were together.

He was transferred to Campo BP Station in California, and when he was being transferred he was told he would be reunited with his wife at the detention center. While in detention, he was not allowed to shower for five days, and the lights were always kept on.

There, a border patrol agent interviewed him in Spanish. The agent asked him about his relatives but did not ask anything about asylum. The man asked if he could present his case. The CBP agent said no, as that was for a courtroom with a lawyer. The man asked why the agent didn’t ask him why he left Cuba, and the agent still said no. After five days, they transported the man to expel him, very early in the morning.

The man says he was disoriented but once he heard he was being expelled he said he can’t leave without his wife. He was told his wife would be joining him soon. This was not true. He was not reunited with his wife and was expelled to Tijuana, Baja California in the early morning hours. A week later, he tried to cross again at Yuma as his wife was still in CBP custody. He was then expelled to Nogales.

A report from the Kino Border Initiative (KBI) and NETWORK described Border Patrol agents’ rough treatment of an asylum-seeking family at a Nogales, Arizona port of entry.

A Salvadoran woman, her husband and two children traveled from El Salvador to Mexico initially to escape threats at home. Soon after, they also received threats in Mexico and decided to flee to the US. They approached the DeConcini port of entry in Nogales.

There, an agent shoved the woman who was eight months pregnant in the chest. The woman pleaded with the agent to not turn them back as they were fleeing danger in Mexico. The agents, both male and female, simply laughed at them when they explained the danger and said the family must go back. When the family said they had nowhere to go, the agents said that was not the agents’ problem. They forcibly removed them and took them to the Mexican immigration office at around 10:30 PM. The family slept by the line of cars entering the United States out of fear of navigating Nogales at night.

On the same day KBI filed the complaint [February 9, 2021], CBP OPR responded with the case number for the Joint Intake Center. Two weeks later, on 2/25/2021, KBI received an email from CRCL stating that they received the complaint, recorded it in their database, and will take no further action. Four months after the complaint was filed, on 6/2/2021, KBI received an email from CRCL saying they received the complaint and forwarded it to the OIG. No details were provided about disciplinary actions for officers or recourse for victims of abuse.

A report from the Kino Border Initiative (KBI) and NETWORK discussed a Guatemalan mother’s inability to request asylum while in Border Patrol custody in Arizona.

A Guatemalan woman and her two children (including a 14-year-old son) fled Guatemala and were detained in the desert upon entry to the US by Border Patrol and taken to the Tucson Station. At the facility, the woman tried to talk to the agents and tell them she could not return to Guatemala because she had suffered violence. The agent said if he allowed her asylum that he would be breaking the law and if he did it for her the agents would have to do it for others. Border Patrol said they had no legal right to seek asylum. They were expelled to Nogales, Sonora. The family was harassed and threatened in Mexico after being expelled.

KBI filed a February 4, 2021 complaint with the DHS Office on Civil Rights and Civil Liberties (CRCL) and the CBP Office of Professional Responsibility (OPR). On April 1, CRCL emailed “that they received the complaint and forwarded it to the OIG. No details were provided about disciplinary actions for officers or recourse for victims of abuse.”

A Border Patrol agent shot and killed Diosmani Ramos, a 23-year-old Cuban migrant, as he emerged from the Rio Grande in Hidalgo, Texas.

Helen Diéguez, Ramos’s partner, told Univisión that when Ramos reached the river bank, the agent was pointing a gun at him. “Diosmani grabbed a stone, the officer told him to drop it, and when the young man did not do so, he shot him in the chest.” When Ramos fell to the ground after being shot, the agent “told him again to drop the stone, he did not drop it because he was on the ground doubled over in pain, and then the agent shot him five more times.”

“If what they wanted was to grab him, there were many ways to do it, not by shooting him six times in the chest. That’s why we believe it was murder,” Diéguez said.

“The incident occurred while the agent was attempting to apprehend a subject and the agent discharged his weapon,” a CBP release noted, adding, “The incident is currently under investigation by the CBP Office of Professional Responsibility, DHS Office of Inspector General, and the Federal Bureau of Investigation (original link).”

A report from the Kino Border Initiative (KBI) and NETWORK detailed the experience of a Honduran woman who had fled, with two teenage sons, after organized crime killed several members of her immediate family.

The guide who was taking them across the border instructed one of the boys to cross first. The woman and the younger son crossed later and were detained at the border in Southern Arizona. CBP officers shouted at them in English, which the woman and boy did not speak. Later, at the CBP station, she told an agent that she wanted to request asylum, and that she had a daughter who was living in the US with special needs. He said that at this time there is no access to asylum for single women. He said only unaccompanied minors could access asylum. She began to cry and said nothing else. She and her younger son were expelled to Mexico.

KBI filed a January 27, 2021 complaint with the DHS Office on Civil Rights and Civil Liberties (CRCL) and the CBP Office of Professional Responsibility (OPR). On February 5, CRCL emailed “that they received the complaint and forwarded it to the OIG. No details were provided about disciplinary actions for officers or recourse for victims of abuse.”

A report from the Kino Border Initiative (KBI) and NETWORK discussed the experience of a Guatemalan man who entered the United States, was detained by an Arizona state trooper, and ended up in Border Patrol custody.

The agents took him to a Border Patrol station. He expressed fear to the agents about returning to Mexico. The agents’ supervisor then said they will decide if they were going to send the Guatemalan man to Guatemala or Nogales. Later, he was taken to the border with a group of other immigrants by the Border Patrol. Everyone was asked to walk across the border to Mexico. He asked the agents why he was being sent to Mexico when he was Guatemalan. An agent hit him with a baton on the knee and threatened to hit him on the head. He was in a lot of pain and his knee became swollen. After that, some other agents came and told him to seek out the Guatemalan Consulate in Nogales and ask about his rights in Mexico. He walked to a park in Nogales, Sonora and slept in a park.

KBI spoke with the local CBP OPR representative on the same day they filed the complaint. OIG had already opened a complaint at this time. An OIG investigator followed up with KBI. Since that date, KBI has not received any updates as to consequences for the officer involved or whether the victim received any recourse.

An October 2020 ACLU document recounted the experience of “Ms. Eva Doe,” who fled Cuba with her husband in June 2019. When they arrived at the Rio Grande Valley’s Hidalgo port of entry to request asylum in September 2019, they were taken into CBP custody. After two days, they were given an immigration court date and sent back across the border into Mexico, under the “Remain in Mexico” program, to await their proceedings. In March 2020, after being brought into the United States for several hearings, an immigration judge denied Ms. Doe’s and her husband’s asylum petition.

The ACLU complaint continues:

They both reserved appeal and were returned to Reynosa for an indefinite period of time. There, the couple faced the tremendous challenges of navigating a global pandemic in a foreign country, without critical resources. Ms.Doe and her husband both fell ill, yet due to their lack of access to medical care, they could not get treatment. Ms. Doe’s husband additionally suffered threats and extortion in Mexico.

Fearful of ever-present threats to their safety, overwhelmed by unrelenting pandemic circumstances, and without legal counsel, the couple was unable to timely submit their immigration appeal. Consequently, the pair made the difficult decision to request asylum once more at a port of entry—this time, in Tijuana. When they arrived at the port of entry, however, U.S. immigration officers told the couple that the border was “closed” due to the coronavirus pandemic, and turned them away.

On September 8, 2020, Ms. Doe and her husband crossed the border between ports of entry, turning themselves in to Border Patrol agents and requesting asylum again. The ACLU continues:

Agents transported Ms. Doe and her husband to the Chula Vista Border Patrol Station. Once there, Ms. Doe notified the agents that she was pregnant, even showing them photos from a recent ultrasound she had undergone while in Tijuana. Notwithstanding, Border Patrol agents separated Ms. Doe from her husband immediately after processing.[6]

The Border Patrol forced Ms. Doe to remove all outer layers of clothing, leaving her upper body clothed in only a sleeveless, thin-strapped blouse. Border Patrol agents gave Ms. Doe a floor mat and silver colored plastic (Mylar) sheet to use as a blanket before placing her in a large holding cell.[7] The toilet and sink to which Ms. Doe had access in her holding cell lacked safeguards for privacy. Ms. Doe was never allowed to bathe while in Border Patrol custody and was instead provided a single moist towelette to clean her entire body every three to four days. She was also only provided a small plastic stick with a sponge tip every three to four days to brush her teeth. The Border Patrol kept the cell lights on 24 hours per day, which made it difficult for Ms. Doe to fall asleep. Ms. Doe felt very cold in the holding cell, unable to warm up with the Mylar sheet, and unable to sleep or rest. Despite her multiple requests, Ms. Doe was denied access to her prenatal vitamins and was never given an equivalent supplement while in CBP custody.

Border Patrol then separated Ms. Doe and her husband:

On her seventh day in Border Patrol custody, Ms. Doe observed agents taking her husband and his belongings out of the holding cell in which he had been detained. She was never given an opportunity to talk to him before he was taken away. She panicked as she saw the agents removing him from the facility, and began banging on the cell door pleading for the agents’ attention. An agent informed Ms. Doe that her husband was being transferred to an ICE detention center and that she would soon be transferred as well. She recalls an agent explaining, to her horror, that many pregnant women are detained in ICE custody and that she could give birth while detained.

As of ACLU’s October 2020 filing, Ms. Doe had been given a November 2020 court date and released from CBP custody. Her husband remained held at ICE’s Otay Mesa Detention Center.

Ms. Doe is currently five months pregnant. Her separation from the father of her child has caused her stress, anxiety, and emotional turmoil. She fears that her husband might not be present for their first child’s birth, and that she will have to go through the experience alone without his support. Worse yet, Ms. Doe’s source of greatest distress is the possibility that her husband will be deported to danger in their country of origin, without ever being be able to see or hold their child.

A CBP officer and a contract security guard shot and killed a man, who was apparently wielding a knife, just inside the U.S. border at the Calexico, California port of entry. The Palm Springs Desert Sun reported:

Pete Flores, director of field operations for U.S. Customs and Border Protection in San Diego, said an individual brandishing a knife approached the agent and the security guard just after 9 a.m. at the international border’s pedestrian crossing.

“As the man approached the CBP officer and the guard with the knife, both drew and fired their weapons, and the man was shot,” Flores said in a written statement.

…Mexican law enforcement officials in Mexicali were dispatched to the pedestrian crossing after receiving reports of an incident there, they said in a statement in Spanish.

Officers observed a man walking toward the gate, carrying a bag over his shoulder. The man was “supposedly” carrying narcotics, the statement said. It said he fled toward the U.S. side of the gate when he saw Mexican police officers.

The man dropped the bag before crossing the international line and, according to the statement, U.S. customs agents shot him after he crossed into the U.S.

According to a CBP statement, the DHS Inspector-General, the FBI, and CBP’s Office of Professional Responsibility were investigating. (Original link) “CBP is also coordinating with the Mexican Consuls General in San Diego and Calexico, Mexican Tax Administration Service (SAT), and the Mexicali Police Department.”

The Mexican consulate in Calexico called on U.S. authorities “for an explanation of the facts and for an exhaustive investigation to clarify the situation, determine responsibilities and determine if there was an excessive use of force.”

A complaint to the DHS Inspector-General, submitted by the ACLU Foundation of San Diego and Imperial Counties and ACLU Border Rights Center, denounced “CBP officials’ egregious verbal abuse of detained individuals,” including “many instances in which Border Patrol agents verbally abused individuals, including children, in their custody,” including asylum seekers.

Agents berated migrants for traveling to the United States and attempting to exercise their legal right to seek asylum.[16] “Xenophobic nationalism is widespread,” and derogatory comments are often accompanied by threatened or actual physical violence.[17] Agents bully LGBTQ people, equate migrants to animals, and ridicule and humiliate parents trying to protect their children.[18]

The complaint cited numerous explicit examples, some of them reproduced below. All are from interviews with migrants completed between March and July of 2019 with people recently released from Border Patrol custody in San Diego and Tijuana.

This abuse may involve bullying, harassment, threats of violence or other harm, denigration, ridicule, racism, and misstatements about U.S. immigration law, including an individual’s right to seek asylum. Recently detained individuals related the following statements to our investigator: [28]

– “Olvídate del asilo, a la mejor te quitamos a tu hija.”
“Forget about asylum, we might just take away your daughter.”
—Border Patrol agent to woman while interrogating her about why she came to the United States.

– “No mantenemos hijos de nadie.”
“We don’t take care of anyone’s children.”
—Border Patrol agent to a mother when she asked for food for her 1-year old child who had not had any food to eat for an entire day.

– “Cabrona, échate para atrás.”
“You bastard, get back over there.”
—Border Patrol agent to woman as she was entering the country and injured from crossing the border wall.

– “¿Desgraciada, ¿porque tienes tantos niños si no los puedes cuidar? Puta, prostituta.”
“Disgraced woman, why do you have so many kids if you can’t take care of them? Slut, prostitute.”
—Border Patrol agent to a detained mother.

– “¿Cuáles de ustedes maricas sufren de asma?”
“Which of you faggots suffer from asthma?”
—Border Patrol agent to a holding cell of young boys aged 13 to 17.

– “If you keep complaining I will put you with the dogs.”
—Border Patrol agent to woman when she refused to undress for a search during apprehension.

– “Son indios de pata rajada, solo usan sus hijos para entrar.”
“You are all [derogatory expression referring to indigenous peoples], you only use your children to enter [the United States].”
—Border Patrol agent to detained father.

– “¡Aquí no se hace lo que voz dice, se hace lo que yo digo!”
“Here we don’t do what you say, you do what I say!
—Border Patrol agent to pregnant woman asking for water.

– “Are you f***ing retarded? Stop playing with that s***.”

– “Váyanse de aquí, ¿qué hacen aquí sí ni hablan inglés?, no valen nada.”
“Get out of here, what are you doing here if you don’t even speak English, you are worthless.”

A complaint from the ACLU Foundation of San Diego and Imperial Counties and ACLU Border Rights Center, based on interviews conducted in San Diego and Tijuana, found “a number of troubling cases in which CBP processing and/or detention led to family separations, including:”

* A woman whose heart condition worsened when, during processing, the Border Patrol separated her and her sister and transferred her sister to a different detention center without any advance notice or opportunity to say goodbye;

* A mother and her two sons (one a minor) apprehended by the Border Patrol and detained in a nearby station; when the mother, who had seriously injured her knee during her journey to the United States, was taken to a hospital for surgery, she was separated from her boys, who were left detained separately at the Border Patrol station. After her return from the hospital, the Border Patrol released the mother and minor son into the United States together, but separated the older son from them and transferred him to U.S. Immigration and Customs Enforcement (“ICE”) detention; [12]

* A grandmother who Border Patrol agents separated from her nine-year-old grandson after agents told her that his birth certificate was insufficient to establish biological familial ties. The grandmother was left anguished and fearful that her grandson would be given up to a U.S. family for adoption; and

* A family of nine which CBP separated into three different family units—notwithstanding the fact that all nine family members initially entered the United States together—and subjected to the so-called “Migrant Protection Protocols.” The entire family was forcibly removed to Mexico, with each of the three “units” then receiving different master calendar hearing dates. This, in turn, resulted in separate nonrefoulement interviews. The stress of this arbitrary and inefficient separation of family members led the mother in the family to experience hyperventilating, vomiting, headache, and chest pain while awaiting her own nonrefoulement interview.

A complaint from the ACLU Foundation of San Diego and Imperial Counties and ACLU Border Rights Center reported on CBP’s failure to implement a detainee locator system, which complicates efforts to reunify separated families:

A detainee locator system allows family members, lawyers, and other advocates to pinpoint exactly where a particular person is being held.[31] Typically, the use of such a system requires knowledge of the detainee’s country of origin and “alien number” (“A number”), or their exact full name, country of origin and date of birth. Unlike ICE, CBP has never implemented a detainee locator system, nor does it facilitate visitation or communications with family or lawyers. CBP’s refusal to do these things aggravates the harms that stem from the agency’s practice of separating family members through processing and detention. Although ICE’s system is far from perfect, advocates and families rely on it to locate their clients and loved ones.

A complaint filed with the DHS Inspector-General by ACLU Texas and Las Americas Immigrant Advocacy Center raised concerns that, at its El Paso “Station 1” facility, Border Patrol had “failed to take even the most basic actions to prevent an outbreak of COVID-19 or mitigate the risk of harm to migrants, particularly the most vulnerable.”

Specifically, notwithstanding the threat from COVID-19, Border Patrol has in its El Paso Station 1 facility:

* Held over 150 persons in a single room with persons exhibiting flu-like symptoms;

* Failed to provide information to detained individuals on the COVID-19 pandemic, such as recommended Center for Disease Control and Prevention (CDC) guidelines for preventing transmission of the virus; [1]

* Held people in cells where they are forced to be in close contact with each other, including by sleeping approximately three feet apart;

* Failed to provide detained individuals with sufficient soap. For example, migrants reported that in one bathroom, only one of six sinks had a soap dispenser that in fact contained soap;

* Provided only a single square of toilet paper per use;

* Denied detained individuals access to hand sanitizer;

* Failed to provide adequate medical screening of detained individuals no texhibiting symptoms of illness; and

* Failed to ensure uniform access to personal protective equipment for everyone in the detention facility.
