The Kino Border Initiative (KBI) reported about two Guatemalan men who were expelled to Nogales, Mexico in the middle of the night:

Pablo and William (not real names) arrived at Kino the morning after Border Patrol agents expelled them to Nogales, México. They are both Guatemalan nationals, and had originally crossed in another location, and so were unfamiliar with the area. They both reported that they were expelled around 2 in the morning. As they did not have anywhere to go, they spent the night out in the open, trying to sleep on the ground, and without anything to protect themselves from the cold. Pablo is an older man, while William is in his early twenties. Pablo indicated that when Border Patrol detained him, he requested medical attention as he felt severely dehydrated. Although he complained to Border Patrol of chest pains and a headache, his request was ignored. It was only after he arrived to Kino that he was finally able to receive medical assistance.

“In March 2022, CBP turned away a Nigerian asylum seeker with urgent medical needs,” reads a report from Human Rights First, the Haitian Bridge Alliance, and Al Otro Lado. “The man had been shot multiple times in Mexico, required a colostomy bag to eat, and urgently needed medical treatment unavailable in Tijuana, according to Nicole Ramos, an attorney with Al Otro Lado.”

The August 16, 2022 San Diego Union-Tribune recounted the story of “Lucy” (real name withheld), a Salvadoran mother who crossed the eastern California border with her children. According to her attorney, Lucy was fleeing death threats.

She claimed that a Border Patrol agent beat her during her apprehension, that she was denied medical attention, and that agents separate her from her 10-year-old daughter.

They were with a group of other migrants resting along a train line in Calipatria — a city about 35 miles north of Calexico — on Feb. 14 when Border Patrol agents found them.

Lucy said she went to wake up her 18-year-old son Anner as the other migrants fled. A Border Patrol agent caught her and began beating her, she said.

“The truth is I thought he was going to kill me because he had hit me so much,” she told the Union-Tribune.

Her children watched in horror and begged another agent to get him to stop, she said, but the other agent said that he couldn’t because of who the agent attacking her was.

Lucy, who is less than 5 feet tall, attempted to free herself from the agent to save herself, she said. Anner threw a couple of rocks near the agent to try to get him to stop.

The agent did stop, and Lucy escaped to where the other agent was standing with her children, she said.

They were taken to a Border Patrol station, and though Lucy was bleeding from the head and lip and already quite bruised, she did not receive medical attention, she said.

She recalled the agents bullying her and laughing at her.

She was placed in a holding area with her daughter, but soon agents came to take Lucy away. It would be more than a month before she even had an idea of where her daughter ended up.

“They didn’t even give me a chance to say goodbye,” Lucy said. “They took me out and handcuffed me.”

She was taken to a federal facility in Arizona to wait because she was being charged with assaulting and intimidating the agent that she says attacked her, a felony. Anner was charged with a misdemeanor and held in another facility.

The FBI agent who investigated the incident noted in a court filing that Anner told him that the Border Patrol agent was punching his mother.

In May, the U.S. Attorney’s Office asked the judge to dismiss the charges, and the case was dropped.

A January 2022 Human Rights First report, discussing implementation of the “Remain in Mexico” (RMX) program in El Paso, recounted examples of denial of medical attention to detained migrants.

A Nicaraguan man told Human Rights First that CBP officers ignored another detainee who lay unconscious on the floor of the cell for hours until other detainees begged for assistance. The Border Project reported that a migrant placed in RMX in El Paso had been held in a CBP detention facility for four days and denied needed blood pressure medication.

A man from Honduras was expelled to Nogales, Sonora late December in a state of extreme dehydration. He was visibly trembling and reported to KBI that for four days he had only drank water, and that he could not keep down any solid food. An ambulance took him from KBI to the hospital, where he received 15 bags of IV fluids.

A young Guatemalan man who was recently expelled to Nogales, Sonora had tried to cross into the US to seek asylum after fleeing threats from extortionists in his hometown. He fell and injured his knee while traveling in the desert. Although he reported his injury to immigration officials, he was not offered medical attention. He was expelled to Nogales at 3AM, where he spent the night exposed in the plaza downtown until the sun came up.

Four children’s defense organizations filed complaints in a California district court after hearing unaccompanied migrant children narrate abuse and poor treatment while in short-term CBP custody during 2021 (original link). The complaints were filed on April 11, 2022 and shared by VICE News on May 2, 2022.

During 2021, attorneys from the Immigrant Defenders Law Center (ImmDef) provided Know Your Rights presentations and conducted legal screenings for at least 2,356 unaccompanied children exiting CBP custody. “During these legal screenings,” reads ImmDef’s complaint, “staff asked children to describe their experience being processed through the U.S. immigration system, with a focus on the conditions in CBP custody.”

“ImmDef has encountered…twenty-three children who suffered medical neglect,” reads the organization’s complaint, which includes the following examples:

  • R.M.M. [a seventeen-year-old child from Guatemala] received medication for three days, but his later requests for medical attention were outright denied. Instead, CBP officers yelled at him and called him names.
  • M.J.C. [a 14-year-old] requested medical attention, which CBP officers denied for three days, instructing her instead to lie down or sleep. CBP officers eventually had to take M.J.C. to a hospital after her symptoms worsened. Doctors later confirmed that her stomach problems were caused by the food provided in the hielera and that she was living with an untreated broken arm that she sustained during her journey. M.J.C. was eventually returned to the CBP facility, where officers withheld her medications and only provided her the same food that made her sick and landed her in the hospital. She became so hungry that she had no option but to eat the dangerous food, which unsurprisingly caused her to experience the same stomach pain. This time, however, she was too afraid to tell the officers that she was in pain and instead suffered in silence.

A June 2022 report from the Marshall Project elaborated on M.J.C.’s story:

It was during that chaos in the spring of 2021 when M.J., an unaccompanied 14-year-old girl from Guatemala, landed in a Border Patrol facility in the Rio Grande Valley of Texas. Instead of the maximum of 72 hours, as required, she was held for 18 days, according to case records reviewed by lawyers with the Immigrant Defenders, who are representing her in her immigration case.

M.J. had been injured in the last days of her journey across Mexico. She leapt from a moving freight train, landing on her shoulder in a bank of rocks, M.J. said in an interview in California in March. (Because she is a minor in legal proceedings, she asked that her name and exact location not be published.)

With her arm swollen and blue, M.J. turned herself in to the Border Patrol soon after crossing the Rio Grande. Agents kept her in handcuffs for 24 hours, she said, aggravating the ache.

She was moved to a vast tent holding families and minors, most likely, based on court documents, in Donna, Texas. Crammed with dozens of girls into a cell defined by clear plastic walls, M.J. slept on a narrow metal bench for nearly three weeks. To leave the cell to use the bathroom, she had to ask each girl for permission to step over. She never had a change of clothes, she said.

She fashioned a sling from a borrowed cloth to relieve the throb in her shoulder. An attendant, citing security rules, took it away, M.J. said. There were nurses on duty, but they declined to give her medication for the pain.

“No one told you to come to the United States,” she said one attendant told her.

The only food was egg burritos and beans, often half-frozen. On the fourth day, M.J. said, she started to vomit from stomach cramps and shoulder pain. The medical staff, relenting, sent her to a local clinic, where examinations revealed a fractured shoulder and severe dehydration.

A physician gave her a sling and prescribed a painkiller. After she was returned to the detention facility later that day, M.J. said, a guard took away the new sling. She never received the medication.

  • When B.T.P. [a Guatemalan girl] asked for medical assistance due to constant headaches, she was first ignored and later told that she would see a doctor. The doctor never arrived.
  • M.G.G. [a seventeen-year-old from El Salvador] also reported a lack of COVID-19 precautions and general medical neglect. When she first arrived, M.G.G. was not given a COVID-19 test and later discovered that there were people with active cases of COVID-19 held in the hielera with her. She was not provided with a mask.
  • The food in the hielera consisted of burritos that tasted spoiled, and L.L.C. [a sixteen-year-old child from Guatemala] soon became sick. When she reported feeling ill to medical staff, they did not address her concerns. As a result, L.L.C. was forced to skip meals. L.L.C. witnessed similar treatment of other children when they felt sick—CBP officers refused to provide medicine and only told the children to drink more water.
  • While crossing the border, M.V.P. [a seventeen-year-old child from Guatemala] hurt the back of her right knee while jumping over a wall. When she asked to see a doctor in the CBP facility, she was given unidentified pills but did not receive any other treatment or follow up.… After four days in CBP custody, M.V.P. began experiencing severe stomach pains and complained to CBP officers. Four hours later, she was taken to a nurse, who did not treat her. After another nine to ten hours of suffering severe pain, M.V.P. was taken to the emergency room, where she was diagnosed with dehydration and put on an IV. When she was discharged from the emergency room, the doctor gave the immigration official paperwork about her condition. M.V.P believes there was more to her condition than dehydration, but she never received a copy of that paperwork.

“It is not limited to one child or one instance,” ImmDef’s complaint concludes.

It is not limited to the conduct of a “bad apple” employee within the agency. It is not limited to even a rogue or remote CBP outpost that lacks training and resources. The sheer number of children who have reported abuse, many of whom told us that they fear retaliation and were afraid to speak up, suggests that these examples are but a fraction of the actual total.

Four children’s defense organizations filed complaints in a California district court after hearing unaccompanied migrant children narrate abuse and poor treatment while in short-term CBP custody during 2021 (original link). During 2021, attorneys from Kids in Need of Defense (KIND) met with about 4,515 unaccompanied minor migrant children at 12 Office of Refugee Resettlement shelters in New York City, Houston, Atlanta, and Seattle. “During these screenings,” reads KIND’s complaint, “minors reported numerous civil rights violations during their apprehension and detention by CBP.”

“Approximately 455 minors, or 10.6% of the minors screened, indicated that they lacked access to sufficient food, water, medical attention, or other basic necessities while in detention,” reads KIND’s complaint. It cites the following examples of denied medical care:

  • Many children reported having symptoms such as fever, ear infection, nausea, stomach pain, sore throat, cough, chills, headaches, and/or body aches while detained, but they were denied access to adequate medical attention when they reported these symptoms to officers. Instead, officers regularly told minors to drink more water or gave the children cough drops or allergy medicine, rather than allowing them to speak with a trained medical professional.
  • One minor, who felt feverish and had a very sore, swollen throat, remembers asking to see a doctor. Officers told her that she could only see a doctor “if she was dying.”
  • Another minor, who was a teenager mother, reports begging officers to take her baby to the doctor after her baby became very ill. The officers first told her that she shouldn’t have left her country if she didn’t want her baby to get sick, and that there would be no “preferential treatment” for her. When the baby’s condition worsened, officers finally agreed to take him to the hospital, where doctors told the mother that the baby had a bacterial infection, likely caused by food he had eaten in detention.
  • After her apprehension [during which she suffered abrasions and bruises], Debra [pseudonym, a 15-year-old minor] was taken to a detention facility and spoke with a medical provider for 2 minutes or less, but they told her there was nothing they could do for her injuries. They did not clean her injuries or provide her with any bandages.
  • Mikayla [pseudonym of a 15-year-old minor] shared that on approximately the 5th day of their detention Cameron, Abel, Mikayla, and other detained children became very sick after eating rice and tortillas that they believed were spoiled because they tasted sour. Other food they ate tasted under-cooked. Mikayla reports that they had stomach cramps, fever, and other flu-like symptoms. She vomited 2 or 3 times. Her brothers were sicker than she was and vomited multiple times a day, multiple days in a row. Mikayla alerted CBP officers at least 5 times that they were sick, but the officers did nothing to help them. Officers told her they did not have medication or medical personnel available to help the children. Mikayla remembers that they said, “This is not a hospital, and we are not doctors. We cannot help you.” Mikayla asked if they could eat anything else instead of the food which had made them ill. Officers replied that they would either eat what was given to them or not eat at all, and that it was not their concern whether the children ate or not.”

Between January 1 and August 13, 2021, attorneys from the Florence Immigrant and Refugee Rights Project completed intakes with about 6,000 unaccompanied migrant children. “Out of those six thousand intakes,” the attorneys’ complaint reads, “the Florence Project documented over 900 reports of abuse and legal violations by CBP. Thus, approximately 15 percent of children we interviewed who passed through CBP custody were victims of abuse at the hands of CBP. That number is unacceptably high and likely undercounts the instances of abuse because many children remained afraid to report it.”

“Approximately 14 children reported being sick or getting sick while in CBP holding centers and not receiving adequate care,” the Florence Project’s complaint reads, citing the following examples:

  • A 16-year-old child was detained for six days in poor conditions and lacked adequate food. The child reported stomach pains from the food the child received and was not given medical attention when it was requested.
  • One child reported having COVID symptoms. CBP officers ignored the child until the child insisted on a COVID test. Upon testing positive, CBP officers refused to assist the child when the child requested toilet paper and water.
  • One child reported getting stomach pains after eating frozen food. The child asked for medical attention but never received it.
  • A child held for five days was very cold and became sick but was not given medical attention despite a request to see a medical provider.
  • One child stated that the child’s sister became sick with a respiratory illness and the nurse told her to just drink water and didn’t provide medicine or a COVID test.
  • A child reported being sick for five days while detained. Although the child was vomiting and had diarrhea, the officers did not provide medical attention. One officer told the child that “if you want medication, you have to stay five more days in detention.”
  • A child reported that the child felt sick while in CBP custody. A CBP officer examined the child and said that the child was fine, but the illness worsened. After the child arrived in ORR custody and was seen by medical processional, the child was immediately instructed to begin taking medication. The child believed that CBP’s failure to provide medical assistance allowed the condition to worsen.

December 2021 guidance for implementation of the “Remain in Mexico” (RMX) program specified that individuals should be exempted from the program if they suffer from mental or physical health issues or disabilities; vulnerabilities from advanced age; or risk of harm due to sexual orientation or gender identity (original link). Despite that, a January 2022 Human Rights First report, discussing implementation of RMX in El Paso, reported several cases of CBP returning vulnerable people to Mexico.

– In December 2021, a gay Venezuelan asylum seeker was returned to Ciudad Juárez under RMX despite having informed CBP officers of his sexual orientation. While in CBP custody the man endured harassment because of his sexual orientation and asked multiple CBP officers if there were any protections for members of the LGBTQ community but was told “no.” The man reported to Human Rights First that he fears harm in Mexico due to his sexual orientation.

– A man with cancer was returned to Ciudad Juárez under RMX, even though he and his attorneys had informed DHS of his condition. As of mid-December 2021, the Border Project reported that DHS said that the agency was attempting to locate the man in Mexico.

– A Nicaraguan asylum seeker who suffers from chronic migraines was nevertheless returned to Ciudad Juárez under RMX in December 2021. The man told Human Rights First that CBP officers did not ask him any questions about his medical condition. The man was returned to Mexico without his medication, which CBP officers discarded while he was in custody. He has suffered several migraines while stranded in a shelter in Mexico.

The Border Project also identified dozens of individuals who CBP officers in El Paso failed to properly exclude from RMX in December 2021 based on DHS’s own screening criteria, including a man living with HIV; a man experiencing pain and limited use of his hand because the Mexican cartel that kidnapped him had amputated part of his finger on a video call with the man’s family to extort money from them; and a dozen LGBTQ individuals, one of whom had been raped and threatened with death in Mexico due to his sexual orientation.

A report from the Border Network for Human Rights included the testimony of “A.V.R.N.,” who had prescription medication taken away by CBP Field Operations personnel at the Santa Teresa Port of Entry in New Mexico, west of El Paso.

In the past months, I had surgery on my leg. On Nov. 13, I went for a follow-up to Juarez so they could remove the nails from my leg. While at the doctor’s, I was prescribed Tramadol with Ketorolac for the pain because I had severe pain. I bought a box with ten pills.

At the Santa Teresa Port of Entry, the officer, who seemed to be of Latin origin, asked me if I was bringing back money or medicine supposedly because he saw me on crutches. I told him I did have medicine with me and showed him the prescription.

The officer then sent me to secondary inspection and told me to step out of the car. After struggling, I was able to get out of the car, and three more officers showed up. An Anglo, a Hispanic female officer, and one Hispanic male officer around 50-60 years old. This last officer was the one who did not allow me to bring in my medicine. The other two officers kept asking him to allow me to bring my medication since I had a prescription and it was only ten pills, which I really needed. But he refused, stating that the prescription was not valid in the U.S. and that the pills were like bringing in weed.

That night I was in so much pain because I could only take Tylenol for my pain.

In a March 2022 report from Robert F. Kennedy Human Rights and the Haitian Bridge Alliance (HBA), narrating the September 2021 mass migration event in Del Rio, Texas, migrants’ testimonies offered several examples of CBP personnel denying medical care.

Many individuals reported that CBP personnel outright denied their requests for medical care, telling them to “go back to Mexico.” Multiple individuals reported that when they requested medical assistance from personnel, instead of medication or medical assistance, they were given a single piece of bread and a hot water bottle. For example, a Haitian man traveling with his wife and two-year-old daughter described how his daughter became very sick with gastrointestinal issues and respiratory issues from the dust.[166] She was vomiting frequently, had a high fever, and visible difficulty breathing. Despite the man’s pleading and repeated requests for help, CBP personnel denied this man’s child medical treatment on September 18th.

A Haitian woman’s son had constant diarrhea and developed a high fever. Eventually her son was so ill that she twice sought help at a medical tent where there were personnel who appeared to be doctors.[167] The woman recalled that the medical personnel treated her baby “like he was nothing.” Instead of paying attention to and treating her son, they kept taunting her by asking her “when her number would be called so that she would be put in jail and then deported.” Eventually they gave her some liquid drops and some ice gel packs for his fever, but those treatments did not appear to help her son’s condition. One couple described that when their nine-month-old child developed a severe rash from the dust, they went to the medic tent on September 21st to request medical assistance. [168] The personnel at the medic tent gave the couple a hot bottle of water and refused to provide the infant with further medication or medical care.

…One newborn infant almost died after being held in the encampment for several days. He survived only after HBA intervened and advocated for his admission to a hospital in Del Rio. The newborn’s condition had grown so precarious that, after he was finally removed from the Del Rio encampment, he had to be airlifted to a hospital in San Antonio, Texas where specialists were able to intervene and provide life-saving medical treatment.[171] One Haitian woman described, “I witnessed pregnant women going into labor taken in to give birth and then sent back under the bridge without further access to healthcare. And that was really heartbreaking for me. I’ll never forget that.”[172] An individual reported that after a pregnant Haitian asylum seeker went into labor, U.S. officials eventually took the woman out of the encampment, but then returned her and her newborn to the encampment mere hours after delivery.[173]

The DHS Inspector General completed an unpublished report, obtained in part and revealed in February 2022 by ProPublica and El Paso Matters, sharing findings about the May 2019 in-custody death of Carlos Gregorio Hernández Vásquez (original link). As the journalistic outlets put it, the victim, a 16-year-old unaccompanied Guatemalan migrant, “died of the flu after writing on the floor of his cell” in the Weslaco, Texas Border Patrol station.

Hernández had a 103-degree fever, tested positive for influenza, and a nurse practitioner had instructed agents in writing “that he should be checked again in two hours and taken to the emergency room if his condition worsened.” Only one medical staff person was on overnight duty at the Weslaco Station, which was being used as a makeshift sick ward and had “60-70” flu patients among 210 ill detainees at the time. Agents logged regular “welfare checks” on the boy, but video footage of his cell showed no evidence of checks during a period of nearly four and a half hours.

The log entries were false, the Inspector-General’s report determined. The lead agent told Inspector General investigators that he made hourly checks of the cell, but

added that at that time, it was impossible for him to conduct welfare checks on 300 to 350 detainees every hour. According to [redacted] common practice, Team Leads check the “select all” tab in the [redacted] system and press enter, reporting all detainees received an hourly welfare check.

“Falsifying federal records to impede administration of an agency’s function is a crime,” ProPublica and El Paso Matters point out. “But the U.S. Attorney’s Office for the Southern District of Texas declined to prosecute anyone in Hernandez’s death, the report said.” The report did not specify whether anyone involved in Hernández’s case had been disciplined. CBP “declined to comment on whether any agents have faced discipline stemming from Hernandez’s death or whether any changes had been made as a result of the inspector general report,” noting that it is continuing an internal investigation of the nearly three-year-old case.

On July 20, 2021, the DHS Inspector-General had reported that, in 98 cases examined of ill people in custody, “CBP could not always demonstrate staff conducted required medical screenings or consistent welfare checks” (original link).

“In August 2021,” a Human Rights First report documented, “DHS expelled Cynthia, a 21-year-old pregnant Honduran woman to Mexico, without providing her water or medical attention after she had begged for something to drink and to see a doctor for stomach pain.” The case is mentioned briefly in the Texas Observer, which identified Border Patrol as the expelling agency. At a Catholic migrant shelter in Reynosa, Mexico, “doctors administered antibiotics for Cynthia’s infection.”

A woman who had severely injured her leg in the desert required emergency medical attention. Border Patrol took her to a hospital where she could be treated, but took her out of the hospital after a day and a half, despite the doctor’s recommendation that she stay for two weeks. Since her clothes were cut to treat her injury, she did not have anything left to wear. BP agents provided her with oversized disposable scrub pants and shirt, and no underwear. They then took her to their processing center, without any consideration for her or her injury. She was expelled into Mexico without proper clothing nor her prescribed medications.

A report from the Kino Border Initiative (KBI) and NETWORK described Border Patrol agents’ violent apprehension of a group of six migrants in Arizona.

A Guatemalan man in a group of six entered the United States and encountered Border Patrol agents. One of the agents pushed one of the men down with a knee on his back. Another man from the group was running, and the dog the agents brought with them attacked him and knocked him face down into a cactus. One of the spines penetrated near his eye, causing his face to bleed. When the man with eye injury asked for help, the agents said no, and that this is what happens to people who come here.

An agent grabbed the Guatemalan man who filed this complaint by the back of the neck and shoved him. The agent lunged to try to shove him again; when he ducked down the agent kept going forward and hurt himself on the cactus spines. Angered by this, the agent grabbed the Guatemalan man by the neck. The man said he felt like he was being choked. The Guatemalan man was injured as he had cactus spines stuck in his legs. He was not allowed to take them out until the next day.

The Guatemalan man’s brother-in-law was also in the group. He was dehydrated and vomiting. As he lay on the ground, begging for water, an agent put his foot on the man’s back and then kneeled on him. It was not until they arrived at a temporary outpost nearly two hours later that they got water.

The group was expelled to Nogales, Sonora the next morning, where Kino then took them to the hospital.

KBI filed an August 4, 2021 complaint with the DHS Office on Civil Rights and Civil Liberties (CRCL) and the CBP Office of Professional Responsibility (OPR). As of August 17, 2021, KBI had not yet received a response.

A report from the Kino Border Initiative (KBI) and NETWORK described the experience of a Honduran family while in custody at Border Patrol’s “Temporary Outdoor Processing Site” (TOPS) facility under a bridge in Mission, Texas, and their subsequent lateral expulsion via Nogales, Arizona.

A Honduran man, his wife, and daughter entered the United States near McAllen, Texas where they were detained. They were kept under an overpass with hundreds of other migrants. The agents took their temperatures and biometric data.

There was a medical tent, but the family could not get medical attention. Their infant daughter became sick while they were there. Although they asked for medical attention for their baby, the agents refused to provide any.

They were held there for three days. This family was exposed to the elements and went without basic necessities like running water, beds to sleep in, etc. They were only fed twice a day.

Border Patrol would periodically call names to board buses; if you missed your name, you had to wait until next time they came to call your name. Because of this, people chose to remain awake rather than risk missing their chance to leave. The father recalls the brutal sleep deprivation this caused.

After three days the Border Patrol transferred them to a facility. At the facility the agents confiscated all their belongings (clothes, medicine, diapers, phone chargers, etc.). They were not given anything to eat at the facility for the whole day. The father was temporarily separated from his wife and daughter and placed in a separate holding facility with about fifty others, who had been at the facility for some time.

Eventually, the agents took down details of the family members they had in the US and told them they could leave once their family members had paid for their travel. This was a lie. The family was instead taken to the airport and flown to Tucson, AZ and then expelled to Nogales, Sonora.

KBI filed an August 3, 2021 complaint with the DHS Office on Civil Rights and Civil Liberties (CRCL) and the CBP Office of Professional Responsibility (OPR). On August 6, CRCL emailed “that they received the complaint and forwarded it to the Office of the Inspector General (OIG). No details were provided about disciplinary actions for officers or recourse for victims of abuse.”

KBI and NETWORK recorded a similar account, for July 30, 2021, of a Honduran family that spent three days at TOPS before being laterally expelled via Nogales.

A report from the DHS Office of Inspector-General found that “CBP needs better oversight and policy” to attend to migrants experiencing medical emergencies or illnesses while in the agency’s custody (original link).

Though the agency had created new policies and expanding contracts of medical personnel at its facilities, “CBP could not always demonstrate staff conducted required medical screenings or consistent welfare checks for all 98 individuals whose medical cases we reviewed.” CBP agents and officers, the report found, were not adequately trained to identify medical attention needs.

A September 14, 2021 Inspector General report on the May 2019 in-custody death of a Guatemalan teenager found that Border Patrol agents had faked log entries of welfare checks that were not performed (original link).

Recently, one of our legal service partners spoke with Maily Martinez, who attempted to cross the border with her husband and son near the Yuma port of entry in early July. Maily was eight months pregnant with twins at the time. When BP agents encountered the family, the woman expressed that she urgently needed medical attention, but the agents ignored her and expelled her back to Mexico. She realized shortly after that the twins had died, likely right around the time that Border Patrol denied her medical aid.

A Noticias Telemundo story about the Honduran woman’s case, citing the hospital in San Luis Rio Colorado, Sonora, noted that the fetuses perished from “interruption of feto-placental circulation.” The news outlet asked Border Patrol about the case; the agency responded, “We do not comment on individual cases due to privacy issues.”

At least five different migrants arriving at our Migrant Aid Center in the last two weeks shared that BP agents have adopted a manipulative strategy to avoid providing medical attention to migrants in their custody. Officers tell migrants at one processing center that they will receive medical attention at the next processing center. When migrants arrive at the next center, agents there tell them the same thing, and the migrants are instead expelled to Mexico without ever having received medical attention.

A report from the Kino Border Initiative (KBI) and NETWORK described a Guatemalan asylum seeker’s experience with her children while in Border Patrol custody in Arizona.

A Guatemalan woman with her four children crossed into the United States with a big group and encountered a Border Patrol agent in a vehicle. That agent was very nice to them, gave them water and said they could have whatever they needed. He called for more vehicles to carry them all, and they were transferred to a Border Patrol facility that was very cold. Then they were put on buses to Tucson.

At the Tucson border facility, the woman approached an agent asking how they should apply for asylum and informing him that her son has a medical condition and needs medical care. She showed him the documents (a diagnosis, x-rays, etc.) to prove that her son was in need and that he needed surgery within the next two months. The agent took the documents and threw them in the trash. When she went to retrieve them from the trash, he took them again and told her “they belong in the trash.” When she protested, he became angry and told her to go away and gave her a sleeping mat. The mat was soaking wet so that she could not use it. She never got her documents back.

Hours later, she and the children were expelled to Nogales, Sonora.

A report from the Kino Border Initiative (KBI) and NETWORK discussed a Guatemalan family’s conditions in Border Patrol custody while seeking, without success, to seek asylum in Arizona.

A Guatemalan woman and her two young daughters entered the United States through the desert and encountered a Border Patrol agent. They were detained and moved to a facility with cold rooms. Then they were transferred to Tucson.

There, she told an agent that she had injured her foot while walking in the desert and needed medical attention. The agent agreed, but then she walked away and never came back. She was never given any medical attention.

They were made to sit in the chairs at the Tucson facility; the children could not sleep. At the facility, they were forced to take off any extra clothing and allowed to wear only a t-shirt and pants. Her daughter was shivering. They asked for blankets but were given only one small one many hours later. She tried to tell agents she wanted to seek asylum, but no one listened to her.

The next morning the family was expelled to Nogales, Sonora.

A report from the Kino Border Initiative (KBI) and NETWORK discussed rough treatment that a Guatemalan man said he received from Border Patrol agents who apprehended him in Arizona.

A Guatemalan man entered the United States through the desert with a group of several others. He encountered Border Patrol agents who tripped him, causing him to fall and injure his knee. His face was injured with thorns. He was in a lot of pain, and he asked for medical attention. The agents said they could not help him. They then forced him to walk for an hour in handcuffs. Then the agents drove him to the border station. He didn’t receive medical attention at the station. He was expelled from that station to Nogales, Sonora. Only after he arrived in Mexico did Kino facilitate medical attention.

A report from the Kino Border Initiative (KBI) and NETWORK described a Guatemalan woman’s account of being denied necessary surgery for a leg injury while in Border Patrol custody, then swiftly expelled to Mexico.

A Guatemalan woman entered the United States and was detained by Border Patrol and transferred to a border patrol facility. She had previously injured herself in the desert and could not walk well. When transported to the facility, a nurse told her she needed surgery to fix a broken bone and torn muscle. She was taken to a clinic where an X ray was taken and found that her tibia was shattered. The medical assistant then told the female border agent who was present that the woman needed an operation right away. The medical assistant told the woman that the surgery was absolutely necessary, and so she agreed to the operation. Then they transferred her to a hospital and changed the Border Patrol agent in of charge of her. It was now a male Border Patrol agent. He received all the paperwork. The woman did not receive any paperwork. The medical staff started prepping for the surgery, then all of a sudden they said they couldn’t do it. The medical staff then gave the woman a sedative and put a cast on. The nurse told her that wherever she goes next, that the women must have surgery. When she asked why they were not continuing with surgery, the medical staff apologized profusely and told her the agents were not going to allow the Guatemalan woman to stay in the U.S. long enough for an operation she desperately needed. Medical staff repeated that she must have surgery as soon as she can because her injuries were serious. The Border Patrol agent there then rushed the woman out of the hospital without allowing the woman to eat or change clothes or get any prescribed pain medication. Though she could barely walk, she was expelled to Nogales, Sonora without any crutches.

A report from the Kino Border Initiative (KBI) and NETWORK recounted Border Patrol agents’ refusal to allow a Mexican migrant in custody to report a drug-related crime.

A Mexican man entered the United States when individuals associated with organized crime demanded he carry a backpack full of drugs into the United States and threatened him with a razor. When he refused, they beat him.

Once the Mexican man regained consciousness, he turned himself in to Border Patrol. He told agents what happened to him, where Border Patrol could find the drugs and the men who assaulted him who belonged to a criminal gang. Still, the agents kept the man in the vehicle the whole day, picking up other immigrants and giving him only water to drink.

Once they came to the CBP facility and he was processed, he repeated what had happened to him. The CBP agent there laughed and asked if he wanted to file a police report. When he said yes, the agent said it would take too long.

He was never given an opportunity to express his fears about returning to Mexico or give information about the crime that had been committed against him. He was never given medical attention while in CBP custody and was left alone in a cell for long stretches of time despite his weakened state. He was soon expelled back to Mexico.
